1. Agreement to Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“Client” or “you”), and FreshSpark Cleaning, a division and DBA of Fatol Group LLC, a limited liability company registered in the State of Texas (“Company,” “we,” “us,” or “our”), concerning your access to and use of our residential and commercial cleaning services. By engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
IF YOU DO NOT AGREE TO ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.
2. Scope of Services
FreshSpark Cleaning offers comprehensive professional cleaning services for residential and commercial clients. Services may include, but are not limited to:
- Routine home and office cleaning
- Deep and seasonal cleaning
- Post-construction or renovation cleanup
- Move-in and move-out services
- Specialized add-ons (e.g., appliance interiors, baseboards, interior windows)
Services are delivered based on availability, scope of work, geographic constraints, and other operational factors.
We reserve the right to refuse any service request that falls outside our standard practices or presents safety, ethical, or legal concerns.
3. Service Requests, Bookings, and Confirmation
3.1. All service requests must be submitted via our official channels: website, mobile platform, email, or phone.
3.2. Booking is confirmed only upon written or digital acknowledgment from FreshSpark Cleaning. Verbal confirmations are not binding.
3.3. FreshSpark Cleaning reserves the right to cancel or reschedule appointments due to availability constraints, force majeure events, or operational considerations. We will make commercially reasonable efforts to notify you in advance.
3.4. Any changes to scope or location post-booking must be communicated no later than 24 hours prior to service commencement
4. Access and Client Premises
4.1. You must provide unhindered, lawful access to the premises during the designated service window. Failure to do so may result in a lockout fee of $50 or full service charge.
4.2. You are responsible for disabling or providing access credentials to any security systems in place. We disclaim liability for any alarm activation due to non-disclosure.
4.3. Premises must be safe, sanitary, and free from hazardous materials. We reserve the right to exit and report any property that violates OSHA standards or applicable laws.
5. Fees, Payments, and Invoicing
5.1. All service fees are subject to prevailing rates and may vary based on property condition, square footage, and location.
5.2. Payment is due at the time of booking unless otherwise stated in a commercial agreement. We accept most major credit/debit cards, ACH, and other approved payment methods.
5.3. Commercial clients may be offered net billing terms (Net 15 or Net 30), subject to credit verification.
5.4. Unpaid invoices will incur a late fee of $25 or 5% of the total outstanding amount per billing cycle, whichever is higher.
5.5. We reserve the right to pursue collection through legal or third-party means after 30 days of non-payment.
6. Cancellations, Rescheduling, and Refund Policy
6.1. Cancellations made with fewer than 24 hours’ notice are subject to a fee equivalent to 50% of the total service charge. No-shows or same-day cancellations may be charged in full.
6.2. Clients are entitled to one complimentary rescheduling if requested more than 24 hours in advance.
6.3. Refunds are not issued post-service unless the Company fails to deliver the agreed-upon scope of work and does not rectify within a reasonable period.
7. Quality Assurance and Re-Clean Guarantee
7.1. FreshSpark Cleaning guarantees satisfaction on all services performed. Any concerns must be reported within 24 hours of completion.
7.2. If deficiencies are confirmed, we will provide a complimentary re-clean of the affected area within 48 hours, subject to scheduling availability.
8. Prohibited and Excluded Services
Our staff shall not be required or expected to:
- Handle hazardous materials, biohazards, or infestations
- Move heavy or valuable furniture or personal belongings
- Operate machinery or utilities not belonging to FreshSpark
- Provide outdoor or structural cleaning requiring ladders above two steps
- Engage in pet waste removal or bodily fluid clean-up
- We reserve the right to decline or discontinue services where these exclusions apply.
9. Limitation of Liability and Indemnity
9.1. FreshSpark Cleaning is bonded and carries commercial general liability insurance.
9.2. You agree to report any claims for damage within 24 hours. Claims reported beyond this period will not be eligible for compensation.
9.3. Our maximum liability for damages or losses is limited to the lesser of:
(a) The total value of the affected item(s) as verified by receipt or market estimate; or
(b) The total fee paid for the affected cleaning service.
9.4. You agree to indemnify and hold harmless FreshSpark Cleaning and Fatol Group LLC from any and all claims, liabilities, or expenses arising from your violation of these Terms or misuse of services.
10. Client Obligations and Conduct
- Provide a safe, sanitary, and respectful working environment
- Remove valuable or delicate items prior to service
- Clearly disclose any known risks, allergies, or sensitivities
- Supervise or restrain pets during the service window
Failure to meet these obligations may result in service suspension or cancellation without refund.
11. Commercial Agreements
11.1. Commercial cleaning agreements are governed by separate contracts that include customized terms, pricing structures, and service level agreements (SLAs).
11.2. Termination of ongoing commercial service contracts requires 30 days’ written notice unless otherwise stated in the signed contract.
12. Data Privacy
12.1. We are committed to protecting your personal data. Information collected is used solely for scheduling, service execution, billing, and customer support.
12.2. We do not sell or share your data with third parties except where required to deliver services or by law.

13. Force Majeure
FreshSpark Cleaning shall not be liable for delays or failures in performance resulting from acts beyond its reasonable control, including but not limited to:
- Natural disasters
- Labor disputes
- Public health emergencies
- Utility failures
- Regulatory changes
14. Legal Entity and Governing Law
FreshSpark Cleaning is a DBA of Fatol Group LLC, a Texas-registered limited liability company. All transactions, disputes, or enforcement of these Terms shall be governed by the laws of the State of Texas, United States, without regard to its conflict of law principles.
